Trichter & LeGrand, PC, a leading Houston criminal defense firm, announced today that J. Gary Trichter, founder and Cowboy Lawyer, will be speaking at the Summer Session of the National College for DUI Defense (NCDD) on July 25, 2013 at Harvard Law School. 

His topic will be, “Lawyer Ethics and the Code of the West: Lessons Learned Over the Last 40 Years.”

Trichter is the founding member and has served the longest tenure on the Board of Regents of the NCDD. He was Dean of the College from 2002 – 2003. 

Trichter has been practicing law in the state of Texas since 1980 and served as president of the Texas Criminal Defense Lawyers Association from June 2011 through June 2012. 

Gary is past chairman of the DWI committees for the Texas Criminal Defense Lawyers Association and for the National Association of Criminal Defense Lawyers.

What is a DWI surcharge?

A DWI surcharge is an administrative penalty charged by the Texas Department of Public Safety as a fee for you to maintain your driver’s license after you have either suffered a DWI conviction or submitted to a breath and/or blood test which showed an alcohol concentration of .16 or more.

For 3 years following either of the aforementioned events, one of these three surcharges will be assessed:

1. $1,000 per year for a first DWI conviction; or
2. $1,500 per year for subsequent DWI convictions; or, 3. $2,000 per year for registering a .16 or more.

If I’m arrested for DWI, when do I have an absolute right to an attorney?

Under our federal and state constitutions, you have an absolute right to an attorney at your trial if you are arrested for DWI

However, such is not the case in every pretrial stage which precedes the trial. 

Indeed, in some pretrial stages, a person in custody has a right to assistance of an attorney for one purpose but not for another purpose, i.e., for assistance in answering police interrogation questions, but not for deciding whether or not to take a breath or blood test.

Generally speaking, any person in police custody wherein it would be objectively viewed as being under arrest – even if the person has not been told that is so – is entitled to be informed of his rights to remain silent, to have assistance of a lawyer prior to and during any interrogation, to have a free attorney if he is financially unable to hire one, and to terminate any such interrogation.
